The Status Quo on education

The Hamodia had an interesting article this past week - it was about the history of the unofficial arrangement that came to be known as "the status quo".

They also printed the letter itself that defined the arrangement, signed by David Ben Gurion and representatives of the Jewish Agency. The copy of the original letter is not really readable but they translate it, and it is easy enough to find the original text online:

הנהלת הסוכנות שמעה מפי היו"ר שלה על מבוקשכם בדבר הבטחת עניני האישות, השבת, החינוך והכשרות במדינה היהודית לכשתקום בימינו.
כפי שמסר לכם היו"ר של ההנהלה אין הנהלת הסוכנות או שום גוף אחר בארץ מוסמכים לקבוע מראש את חוקת המדינה היהודית לכשתיווסד. הקמת המדינה זקוקה לאישור האו"מ, וזה לא יתכן אם לא יובטח חופש המצפון במדינה לכל אזרחיה ולא יהיה ברור שאין הכוונה להקמת מדינה תאוקרטית. במדינה היהודית יהיו גם אזרחים לא יהודים- נוצרים ומוסלמים, וברור שמן ההכרח יהיה להבטיח למפרע שוויון- זכויות מלא לכל האזרחים והעדר כפיה או אפליה בענייני דת או בעניינים אחרים.
שמענו ברצון שאתם מבינים שאין שום גוף מוסמך לקבוע למפרע חוקת המדינה ושהמדינה תהיה בתחומים מסוימים בת-חורין לקבוע את חוקתה לפי רצון אזרחיה.
יחד עם זאת מעריכה ההנהלה את תביעותיכם והיא יודעת שאלה הם דברים המדאיגים לא רק חברי אגודת ישראל בלבד, אלא רבים משלומי אמוני ישראל שישנם במחנות הציונים ומחוץ לכל מפלגה, והיא מתייחסת בהבנה גמורה לתביעותיכם שהנהלת הסוכנות תודיע לכם מה עמדתה היא בשאלה שהצגתם, ומה היא מוכנה לעשות, במידה שהשפעתה והכרעתה מגעת, למען מלא מבוקשכם בשאלות הנזכרות.
הנהלת הסוכנות מילאה את ידי החותמים מטה לנסח את עמדתה בשאלות אשר נקבתם בשיחה, והרינו מודיעים לכם בזאת את עמדת הסוכנות:
          א.          שבת. ברור שיום המנוחה החוקי במדינה היהודית יהיה יום השבת, כמוכן מתוך מתן רשות לנוצרים ובעלי דת אחרת לשבות ביום החג השבועי שלהם. 
          ב.          כשרות. יש לאחוז בכל האמצעים הדרישות למען הבטיח, שבכל מטבח ממלכתי המכוון ליהודים יהיה מאכל כשר. 
          ג.          אישות. כל חברי ההנהלה מעריכים את רצינות הבעיה וקשייה הגדולים, ומצד כל הגופים שהנהלת הסוכנות מייצגת, ייעשה כל מה שאפשר למען ספק בנידון זה את הצורך העמוק של שלומי הדת, למנוע חלילה חלוקת בית ישראל לשניים. 
          ד.          חינוך. תובטח אבטונומיה מלאה של כל זרם בחנוך (אגב משטר זה קיים גם בהסתדרות הציונית ובכנסת ישראל גם עכשיו) ולא תהיה שום פגיעה מצד השלטון בהכרה הדתית ובמצפון הדתי של שום חלק בישראל. המדינה, כמובן, תקבע את המינימום של לימודי חובה, הלשון העברית, היסטוריה, מדעים וכדומה, ותפקח על מלוי מינימום זה, אבל תתן חופש מלא לכל זרם לנהל את החינוך לפי הכרתו ותתרחק מכל פגיעה במצפון הדתי.

I commend the Hamodia for actually printing the letter and translation, as they could have just gone with the history and description, in which they can be vague enough and only point out what they want. But they did print it, and that gives the reader the opportunity to see what it actually says..

A lot can be said about each part of the letter, but I just want to point out the one thing that struck me right away when I first read it. And that is regarding item #4 in the details of the arrangement. The point regarding education.

I translate:
4. Education: complete autonomy of each education system will be guaranteed (as an aside, this arrangement is already in place between the Zionist Agency and Knesset Israel even now) and the government will not violate the religious status and religious conscience of any group of Jews. The State, of course, will determine the minimum obligatory courses, Hebrew language, history, science, etc. and will supervise compliance with this minimum, but it will give full freedom to every stream to manage education as  it sees fit, and will stay away from encroaching on their religious conscience.

What I noticed is the right of the State to determine minimum obligatory courses, including Hebrew, history, science, and anything else it determines as necessary. So while every change or act by the government in religious issues or policy draws fights and opposition using the "status quo", it seems that the original agreement (arrangement) included allowing the government to require minimum standrads of general education.

Why is compliance with the "status quo" only enforced in one direction, but any attempt to determine and require a minimal general education nowadays is opposed by the Haredi community? If the status quo is in effect, and one can argue whether it is or is not, but the Haredi askanim and politicians clearly consider it to be binding, where is the general education in the Haredi school system?

  1. In other words, what the government is trying to do today is not against the original status quo but rather is trying to enforce it.

  3. Both sides always use the status quo to protect their position, but ignore it or if necessary claim it doesn't apply when they want to do something not in line with the status quo.

  4. I dont remember ever hearing the government use the argument of "status quo" in order to impose educational standards or for anything else. I might be wrong, but I dont think so.

    1. back in the eighties and early ninties it was more common. today almost no one does.

  5. Read the exact item and the same question came to mind?

    Plus the entire status quo was for Talmidim who spent the entire day in learning, when will someone talk about the 'pink elephant' of those who are Charedim and are not in full-time learning? Seems that that was a given at the time that they would be serving.
